The Europrotocol is a way for the parties to register a road accident themselves, without calling traffic police (GIBDD) officers. It saves hours of waiting, but works only under certain conditions and with a cap on the payout. The rules are set out in Article 11.1 of Federal Law No. 40-FZ on OSAGO (compulsory motor third-party liability insurance). Below is the current procedure for 2026.
When you can use the Europrotocol
Three conditions must be met at the same time:
- only property was damaged — nobody was injured or killed;
- two vehicles were involved (including with trailers), and both owners have OSAGO;
- the parties describe the circumstances and visible damage in the same way — or the accident has been recorded in the way the law requires for cases with disagreements (see below).
The Europrotocol also covers foreign-registered vehicles insured under international systems, such as the Green Card, subject to the specifics set by law.
Payout limits
| Situation | Maximum payout to the victim |
|---|---|
| Standard registration on a paper form, no disagreements | RUB 100,000 |
| There are disagreements, but the accident data was recorded and transmitted via an app or a GLONASS-based device | RUB 200,000 |
| No disagreements, and the accident data was recorded and transmitted in the prescribed way | RUB 400,000 (the general OSAGO property limit) |
The law names two recording methods: monitoring devices that transmit tamper-proof data on the accident and the vehicles' coordinates based on GLONASS signals, and software, including software linked to Gosuslugi (the state services portal), that photographs the vehicles and damage at the scene. In practice these are the "Gosuslugi Avto" and "DTP.Europrotocol" apps.
If the data did not reach the insurer, this is no reason to refuse a payout within RUB 100,000 when there are no disagreements.
Step-by-step procedure
- Stop and make the scene safe. Switch on the hazard lights, put out the warning triangle and check that nobody is hurt.
- Check the policies. Make sure the other party has valid OSAGO: ask for the policy number and verify it via the check service.
- Take photos of everything before moving the cars. A general view, the position of the cars, number plates, close-ups of the damage, road signs and markings.
- Fill in the accident notice. On a paper form — one set for both drivers, and both drivers sign both sides. Electronically — via Gosuslugi, the insurer's website or app, or the information systems of the RSA (Russian Union of Motor Insurers).
- If you need the higher limit, record the accident in the app right at the scene: the photos are taken following the app's prompts and sent with coordinates.
- Clear the roadway if the cars are obstructing traffic.
- Contact the insurer. The victim submits the notice together with a claim for direct settlement of losses to their own insurance company.
Deadlines you must not miss
- 5 working days from the accident — send your copy of the notice to your insurer. Both drivers are obliged to do this.
- 5 working days from receiving the insurer's request — present the car for inspection or an expert examination.
- 15 calendar days from the accident (not counting non-working public holidays) — you may not repair or scrap the car without the insurer's written consent.
If the at-fault driver breaches these deadlines, the insurer may bring a recourse claim against them, and the victim may face disputes over the amount of damage.
How to fill in the notice correctly
- Write legibly and without corrections; if you make a mistake, take a new form.
- In the accident diagram, show street names, directions of travel, the position of the cars at the moment of impact and the signs.
- Mark all visible damage, including minor items: scratches on the bumper, cracked headlights.
- In the "Remarks" field the at-fault driver can state directly that they admit liability.
- Write down each other's phone numbers and the details of any witnesses.
Keep a paper notice form in the car — you can get one at an insurer's office — in case your phone battery is flat or there is no signal to register via the app.
What the Europrotocol does not give you
Having received a payout under the Europrotocol, the victim can no longer claim an additional payment from the insurer for damage to the car above the limit. If you can see that the repair will clearly cost more than RUB 100,000 and there is no way to record the accident via the app, it is wiser to call the traffic police. The exception is harm to health that appeared later and that you were unaware of at the scene: such a claim can be made to the at-fault driver's insurer.
When the Europrotocol is not suitable
- three or more cars are involved;
- someone is injured;
- one of the parties has no OSAGO or the policy is invalid;
- the parties disagree and the accident cannot be recorded via the app;
- other property besides the two cars is damaged — for example, a barrier or a post.
In these cases, register the accident with the traffic police. The full procedure is described in "What to do after a road accident: a step-by-step guide for OSAGO and KASKO".
If the insurer refuses or underpays
First send the insurer a written claim. If the response does not satisfy you, an OSAGO dispute is considered by the financial ombudsman — free of charge and with no cap on the amount claimed. More in "The financial ombudsman: how to complain about an insurer".
What else has changed in OSAGO this year is covered in "OSAGO in 2026". Polis Re specialists will help you choose an OSAGO or KASKO (comprehensive motor insurance) policy.
