Disputes after road accidents are the most common type of insurance conflict in Russia. The subject is almost always one of three things: whether there was an insured event, who is at fault and how much the repair costs. The outcome depends on evidence, which should be collected from the first minutes after the accident.
Typical reasons for disputes
- Underpayment. The insurer assessed the damage lower than expected or deducted wear and tear of parts.
- Doubts about the circumstances. The company believes the damage does not match the mechanics of the accident (a so-called trace analysis mismatch).
- Dispute over fault. The participants describe the incident differently, and the documents do not make it possible to identify the at-fault party unambiguously.
- Form of indemnity. Under OSAGO (compulsory motor third-party liability insurance), repair rather than cash is the priority for passenger cars owned by individuals. Disputes arise when the insurer fails to arrange repairs or unilaterally replaces them with a cash payment.
- Procedural breaches. Notification deadlines were missed, the car was repaired before inspection, documents were not submitted.
What evidence to collect
- Photos and videos of the accident scene: a general view, positions of the cars, braking marks, glass debris, signs and road markings, close-ups of the damage.
- Dashcam recordings — your own and, if possible, those of other participants and eyewitnesses. Do not delay requests to preserve street camera footage.
- Witness contact details.
- Traffic police (GIBDD) documents or an accident notification (the “European protocol”), filled in without corrections and with an agreed diagram.
- The insurer’s inspection report: attend the inspection and add your comments if you disagree with anything.
Expert assessment is the key
The insurer’s assessment
Under OSAGO, the insurer must inspect the damaged vehicle and arrange an independent technical assessment. The repair cost is calculated using the Bank of Russia’s Unified Methodology and reference books of average prices for parts and labour hours. You have the right to see the inspection and assessment results — ask for a copy of the report and the cost estimate.
Your own assessment
If you disagree with the calculation, engage an expert technician listed in the state register. Under OSAGO the sequence matters: your own assessment is justified primarily when the insurer did not arrange an inspection on time. In other cases it is wiser to apply to the Financial Ombudsman, who can order an assessment free of charge for the consumer. Always notify the insurer of the time and place of the inspection.
Court-ordered assessment
In court, the parties may propose an expert institution and questions for the expert, and the court makes the final decision. If you disagree with the findings, you may request a repeat or additional assessment, pointing out specific flaws in the report: incomplete examination, wrong part numbers, an incorrect collision mechanism.
If the insurer suspects fraud
Insurance companies check suspicious claims: staged accidents, inflated damage, set-ups. An honest participant has nothing to fear: provide documents, give explanations in writing and do not sign statements you disagree with. A refusal based on suspicion must be reasoned, and it can be challenged.
OSAGO deadlines
The insurer must make a decision and pay the indemnity or issue a repair referral within 20 calendar days (excluding non-working public holidays) after receiving all documents. A penalty of 1% of the indemnity accrues for each day of delay, and if a court upholds the claim, a fine of 50% of the awarded amount is added.
How the dispute is resolved
Individuals must follow a mandatory pre-trial procedure: a claim to the insurer, then an application to the Financial Ombudsman (for OSAGO — for any amount, for KASKO — up to 500,000 rubles), and only then court. The steps are described in detail in “Disputes with an Insurer in Russia”.
How to reduce the risk of a dispute
- choose an insurer with a clear claims procedure — compare companies in the directory;
- when buying KASKO (comprehensive car insurance), clarify the form of indemnity and how damage is assessed;
- check the details in your OSAGO policy: drivers, vehicle, period of cover;
- do not repair the car before the insurer has inspected it;
- for a minor accident without injuries, use the European protocol with recording via a mobile app.
